Policy on Name, Image and Likeness Background
Effective July 1, 2021, Pennsylvania law protects the right of college student-athletes to earn compensation for the use of their name, image and likeness (NIL). This is an excellent opportunity for Temple student-athletes to further their education and prepare for life after graduation through activities such as personal brand development, communications, and marketing. In accordance with Pennsylvania law, there are some rules and guidelines that will have to be followed in order to exercise your rights, as described in this policy.
 
The following policy attempts to summarize the requirements of the Pennsylvania law and Temple policy in a simple, straightforward way. If you’d like to read the actual legislation, you can find it here.
 

Relationship to Temple

Under the Pennsylvania law, the university is not allowed to interfere with your right to earn NIL compensation, but is allowed to make and enforce academic standards, team rules, and policies regarding the operation of intercollegiate athletics. Your contracts for NIL compensation are not allowed to conflict with existing university contracts, such as sponsorships. The Athletic Department will work with you to help ensure that your NIL activities comply with Pennsylvania law and university policies and procedures. It is the university’s expectation that NIL activities will not conflict with academic or team-related obligations.
 

Financial Considerations

You are not allowed to earn NIL or any other compensation in exchange, in whole or in part, for attendance at Temple, or participation or performance in intercollegiate athletics at Temple (i.e., “pay for play”). In addition, Temple, its employees (including coaches, athletic department staff members and athletic administrators) are not allowed to arrange NIL compensation for you.
 
Earning NIL compensation will not affect your athletic grant-in-aid. However, it could affect your Pell Grant or other need-based financial aid. If you have questions about the impact of NIL compensation on your need-based aid, please contact Student Financial Services.
 

International Athletes

International student-athletes should not enter into any contracts for NIL compensation before contacting International Student and Scholar Services to discuss any potential immigration issues.
 

Rules of the Road

Under the Pennsylvania law, you may not earn NIL compensation in connection with adult entertainment, alcohol, gambling, tobacco and electronic smoking, prescription drugs, or controlled substances (including cannabis). In addition, you may not earn NIL compensation in a manner that violates

Temple’s Student Conduct Code. Under NCAA guidelines, you are not allowed to receive NIL compensation without providing value for the amount earned.
 
You may not use Temple University’s uniforms, registered trademarks, products protected by copyright, or official logos, marks, colors or other indicia in connection with your NIL activities unless approved in advance by the Office of Business Services and Strategic Marketing & Communications. To seek approval, please contact NILRequests@temple.edu.
 
Any use Athletic Department facilities in connection with your NIL activities must be approved in advance, including payment of applicable fees and execution of a facilities use agreement. In order to request the use of facilities, please contact Bryan Kulp, Assistant AD/Facilities & Event Management, at bkulp@temple.edu.
 

Agents

The Pennsylvania law permits you to have an agent to assist with your NIL activities, but only with those activities. If you retain an agent to represent you for your athletic ability, you will no longer be eligible for intercollegiate athletics. The agent can be an “athlete agent” as defined by Pennsylvania law, or a financial advisor, or a lawyer – so long as the agent is licensed in Pennsylvania. Anyone working you as an agent must register with the Athletic Department by contacting compliance@temple.edu for necessary forms.
 

Education

The Athletic Department is partnering with Temple academic programs to develop education and training for Temple student-athletes regarding NIL activities in the form of online tutorials, seminars, and academic courses. If you are interested in any particular aspect of NIL, just want to learn more, or have ideas that you think are worth sharing with other student-athletes, please contact the Resnick Academic Support Center.
 

When You’re Ready . . .

Under the Pennsylvania law, you must notify the Athletic Department of all contracts for NIL compensation. Provide this notice by filling out and submitting a disclosure via the INFLCR application.  You will be contacted regarding any university policy or conflict issues to be worked out with respect to your contract.
 
Please note that the university cannot and will not give advice on whether a contract is a “good deal” for you, or otherwise serve as your advisor for your NIL activities. The purpose of the Pennsylvania legislation, like others around the country, is to empower student-athletes to take charge of the value that their name, image and likeness can generate.
